Welcome to Anchor Africa Safaris. By booking a safari with us, you agree to be bound by the following terms and conditions. These terms govern your relationship with Anchor Africa Safaris and outline our mutual responsibilities to ensure a safe, enjoyable, and memorable safari experience.

1 Booking and Payment

  • Deposit Requirement: A non-refundable deposit of 30% of the total tour cost is required to confirm your booking
  • Final Payment: Full payment must be received at least 60 days before your departure date
  • Payment Methods: We accept bank transfers, credit cards (Visa, Mastercard), PayPal, and other secure payment methods
  • Currency: All prices are quoted in EUR or USD and are subject to change based on currency fluctuations and fuel costs
  • Late Bookings: For bookings made less than 60 days before departure, full payment is required at the time of booking
  • Confirmation: You will receive written confirmation once your deposit is received and processed

2 Cancellation Policy

  • More than 90 days before departure: 10% cancellation fee (90% refund)
  • 60-90 days before departure: 30% cancellation fee (70% refund)
  • 30-59 days before departure: 50% cancellation fee (50% refund)
  • Less than 30 days before departure: 100% cancellation fee (no refund)
  • No-show: 100% of total tour cost will be charged
  • Travel Insurance: We strongly recommend comprehensive travel insurance to protect against unforeseen circumstances, including trip cancellation, medical emergencies, and travel delays
  • Refund Processing: All refunds will be processed within 30 business days of cancellation

3 Travel Documents and Visas

  • Passport Validity: Your passport must be valid for at least 6 months beyond your return date
  • Visa Requirements: Clients are responsible for obtaining all necessary visas and entry permits for Kenya and any other countries visited
  • Kenya Visa: Most nationalities can obtain a Kenyan e-visa online before travel or upon arrival
  • Yellow Fever Vaccination: Proof of yellow fever vaccination may be required if arriving from or transiting through endemic countries
  • Travel Advice: We provide guidance and information, but are not responsible for visa denials or entry refusals
  • Document Accuracy: Ensure all booking information matches your passport exactly

4 Health and Safety

  • Medical Disclosure: Clients must disclose any medical conditions, allergies, or dietary requirements at the time of booking
  • Fitness Requirements: Some activities require a reasonable level of fitness. Please consult with us if you have concerns
  • Travel Insurance: Comprehensive travel and medical insurance is mandatory for all clients
  • Vaccinations: Consult your doctor about recommended vaccinations, including hepatitis, typhoid, and malaria prophylaxis
  • Personal Risk: Clients participate in all activities at their own risk. Wildlife safaris involve inherent risks
  • Guide Instructions: For your safety, always follow instructions from guides and lodge staff
  • Emergency Procedures: All our vehicles carry first aid kits and communication equipment for emergencies

5 Liability and Insurance

  • Company Insurance: Anchor Africa Safaris carries comprehensive public liability insurance as required by Kenyan law
  • Force Majeure: We are not liable for delays, losses, damages, or injuries resulting from circumstances beyond our control, including weather, political instability, natural disasters, or pandemics
  • Personal Belongings: Clients are responsible for the security of their personal belongings at all times
  • Vehicle Breakdown: While our vehicles are well-maintained, we cannot be held liable for delays due to mechanical failures. Alternative arrangements will be made promptly
  • Wildlife Encounters: Wildlife viewing involves inherent risks. We are not liable for injuries resulting from wildlife encounters when safety guidelines have been followed
  • Accommodation Issues: We work with reputable lodges and camps but are not responsible for their standards or services beyond our control
  • Third-Party Services: We are not liable for the acts or omissions of third-party service providers

6 Itinerary Changes and Modifications

  • Right to Modify: We reserve the right to modify itineraries due to circumstances beyond our control, including weather, road conditions, or park closures
  • Alternative Arrangements: If changes are necessary, we will provide alternative accommodations and experiences of equal or higher standard
  • Wildlife Sightings: Wildlife viewing is never guaranteed. Animal movements are natural and unpredictable
  • Seasonal Variations: Safari experiences vary by season. We will inform you of the best times to visit for your specific interests
  • Client Changes: Any client-requested changes after booking confirmation may incur additional fees
  • Notification: We will notify clients of any significant itinerary changes as soon as possible

7 Privacy and Data Protection

  • Information Collection: We collect personal information solely for booking and providing safari services
  • Data Security: Your data is stored securely using industry-standard encryption and security measures
  • Third-Party Sharing: Personal information is never sold or shared with third parties for marketing purposes
  • Service Providers: We may share necessary information with lodges, airlines, and other service providers to fulfill your booking
  • Compliance: We comply with international data protection regulations, including GDPR where applicable
  • Data Rights: You have the right to access, correct, or request deletion of your personal data at any time
  • Communication: By booking, you consent to receive communications about your safari and relevant travel information

8 Client Responsibilities

  • Accurate Information: Provide accurate and complete information during booking
  • Timely Payments: Make all payments according to the agreed schedule
  • Travel Documents: Ensure all passports, visas, and vaccination certificates are valid and current
  • Insurance: Obtain comprehensive travel and medical insurance before departure
  • Punctuality: Arrive on time for all scheduled activities and transfers
  • Respectful Behavior: Treat guides, staff, local communities, and wildlife with respect
  • Environmental Responsibility: Follow leave-no-trace principles and conservation guidelines
  • Park Rules: Adhere to all national park and conservancy regulations

9 Governing Law and Disputes

These terms and conditions are governed by and construed in accordance with the laws of Kenya. Any disputes arising from these terms or your safari booking shall be resolved through arbitration in Nairobi, Kenya, in accordance with Kenyan tourism regulations and the Kenya Tourism Board guidelines. Both parties agree to make good faith efforts to resolve any disputes amicably before pursuing formal arbitration.

10 Photography and Marketing

  • Image Use: By participating in our safaris, you grant Anchor Africa Safaris permission to use photographs and videos taken during the tour for marketing purposes
  • Opt-Out: You may opt out of photograph usage by informing us in writing before your safari
  • Social Media: We encourage sharing your experiences on social media and tagging @anchorafricasafaris
